Gay Police Officer Jailed For Sexual Assault
November 26, 2009
A gay police sergeant was jailed for 8 months for sexually assaulting a fellow officer who passed out after becoming heavily intoxicated at the yearly Christmas party.
David Stephens was caught sexually assaulting a colleague, after being caught red handed by two other officers who attended the December 2, 2008 Christmas party.
The victim, who is in a long-term relationship with a woman, passed out in one of the hotel rooms, where Stephens then took advantage of him fondling him, while totally incapacitated.
Another officer decided to go and joke with the victim for his inability to hold his drink, resulting him walking in on Stephens lying on top of the victim.
A jury of his peers at the St Albans Crown court found Stephens guilty last month, with sentencing taking place this week. Presiding Judge Martin Griffith upon sentencing told Stevens: "There is only one sentence I can pass and that sentence is one of immediate custody. You saw his drunken figure and you decided to take advantage of him.
"The courts have a duty to protect vulnerable people especially in this day and age when people drink themselves into such a state they cannot look after themselves."
Susannah Stevens, barrister for the defendant said: "As a police officer add to that a police sergeant add to that the fact that he is gay add to that he is to be sentenced for a sex offence he will be regarded in prison as the lowest of the low."
"There is a concern about his mental health. He has been receiving counseling and is a suicide risk."
Stephens, who as a result of the incident had to come out to his father, said: "He opened his eyes and looked at me. He looked at me and smiled and I sat on the bed. It was the worse mistake of my life.
"It seems his look and his smile was acceptance and I wanted to see what would happen and I wanted to be closer to him."
"Going into that room.... has ruined my career and humiliated me in front of my family and friends."
Stephens will now have to finish his jail time and will be placed on the sex offender’s register, where he will appear for the next 10 years.
